A class action lawsuit alleging The Standard Market LLC violated the Illinois Biometric Information Privacy Act (BIPA) by disclosing biometric identifiers to third parties has resulted in a $1.25 million settlement.
The Standard Market class action lawsuit alleged the company violated BIPA by asking employees to provide their fingerprints to clock in and clock out without the required disclosures and consent.
The company could not afford to pay the full settlement, so its insurer West Bend Mutual Insurance Co. is paying the settlement fund.
The Standard Market is a fresh food market that also provides events and catering. The company is based in Westmont, Illinois, and employs more than 300 people.
Each member of the settlement class that does not opt out and who submits an approved claim form will be mailed a check for $750, subject to pro rata reduction if total claims would otherwise exhaust the settlement fund.
